Any errors in the data that are not promptly reported may lead to extra costs for the Purchaser.

If registered with the Website, the Purchaser can view each order in his/her personal area; if not registered, he/she may contact DERMOPHISIOLOGIQUE Customer Service immediately after sending the order.

It may happen that certain Products offered via the Website are temporarily unavailable. In this case, where the Products selected by the Purchaser are not wholly or partially available, those Products that are currently available will be delivered, after sending a communication to the Purchaser concerning those that are not available.

DERMOPHISIOLOGIQUE has the right to decide whether or not to accept the order sent by the Purchaser; the latter does not have the right to make any claim or raise any other objection whatsoever, in any capacity, including demands for compensation, should the order be rejected.

More specifically, DERMOPHISIOLOGIQUE reserves the right not to accept proposals and to cancel orders with an insufficient guarantee of solvency, such as when there are anomalies in transactions and the means of payment used by the Purchaser, including reports from the circuit that handles credit card payments.

Purchasers can check the contents of their purchase contracts at any time by accessing their personal area of the Website, if registered, or by sending an email to DERMOPHISIOLOGIQUE Customer Service at: servizioclientiweb@dermophisiologique.it . The data will be available for a period of 12 months from delivery of the Products.

The price of each Product is clearly indicated on the Website and is inclusive of VAT. Delivery costs are suitably pointed out at the time of placing an order. The cost of each shipment will vary to suit the mode of delivery and payment, as well as the destination and the total amount of the order.

DERMOPHISIOLOGIQUE will issue an invoice for the purchased Products once they have been delivered to the carrier and will email this to Purchaser. The data supplied by the Purchaser are used to produce the invoice; once an invoice has been issued it is not possible to make any alterations to said data.

As explained in detail below, payments by credit card and PayPal only require an authorisation (i.e. reservation of money without any actual debit) when the Purchaser places an order. The amount is, therefore, only taken from the Purchaser's account when the Products are delivered to the carrier responsible for shipment. It is at this point that DERMOPHISIOLOGIQUE actually issues its invoice for the order. Payment for the purchased Products can only be made by credit card, PayPal or cash on delivery in the manner specified below:

Credit cards online

The following credit cards are accepted: Visa, Mastercard (insert list of accepted credit cards).

All data is transferred in encrypted form using SSL certificate and cannot, therefore, be intercepted by third parties.

Moreover, the data is entered directly via the bank's own website, thus ensuring maximum safety.

The total amount due for the order will not be charged to the card immediately, but at a later stage, within the limits authorised by the Purchaser.

At the time of placing an order via the DERMOPHISIOLOGIQUE Website, authorisation for payment for the amount specified is requested (an SMS and/or email is normally sent to the Purchaser by the issuing bank).

Said authorisation does not imply the actual debit of the amount due, but simply reserves it for payment.

The amount due only becomes payable once the order has been delivered to the carrier, freight forwarder or any other person appointed by DERMOPHISIOLOGIQUE for final delivery purposes.

This ensures that the amount is only charged to your credit card at the actual material and certain time of shipment of the Products and only for the amount for those Products actually sent.

b) PayPal

PayPal, an eBay company, is a quick and safe online payment system.

After completing the order and chosing PayPal as the payment method, Purchasers are redirected to the PayPal website, where they can access their account by entering their email address and personal password.

Once registered with the DERMOPHISIOLOGIQUE Website, Purchasers can make payments via PayPal without having to re-enter data each time, even for subsequent purchases.

By choosing to pay with PayPal the amount is charged directly to the Purchaser's assigned credit card (Visa, Visa Electron or Mastercard) or debit card. PayPal protects the Purchaser's data as no financial information is passed on.

The Purchaser receives an email of confirmation from PayPal for each transaction made using this method.

Please note that the total amount due for the order is debited from your PayPal account once the carrier has received the order. When completing the order on the Website there is only a request for permission to check the availability of funds on the Purchaser's PayPal account; no money is actually debited.

Should an order be cancelled, the amount will be refunded to the Purchaser's PayPal account.

c) Cash on delivery

The Purchaser can pay the amount due directly to the carrier upon delivery of the ordered Products.

Only cash can be accepted with this method of payment. The carrier will not accept cheques or bank drafts and will not deliver the Products if it does not receive the exact amount indicated in the order. The carrier is not allowed to give change.

DERMOPHISIOLOGIQUE delivers to all the countries listed on the Website and delivery takes place without an appointment (click kere).

DERMOPHISIOLOGIQUE cannot be held liable, for any reason whatsoever, for any delay in processing an order or the delivery of the Products in a Purchase Contract.

The ordered Products will be sent to the address specified by the Purchaser. Once DERMOPHISIOLOGIQUE has delivered the Products to the carrier specified in the order, it will send the Purchaser an email confirming shipment.

Deliveries are made from Monday to Friday, during normal business hours, excluding public holidays, as specified by the carrier chosen by the Purchaser. Delivery is considered completed when the product is made available to the Purchaser at the address specified in the order form. In the event of non-delivery owing to the absence of the recipient at the specified address, the carrier will send the Purchaser an email and will then attempt a new delivery in the manner agreed between them.

If it is again impossible to deliver the Products owing to the absence of the recipient, DERMOPHISIOLOGIQUE Customer Service will attempt to contact the Purchaser to schedule a further delivery. If DERMOPHISIOLOGIQUE Customer Service fails to contact the Purchaser within the following 14 (fourteen) days or delivery is impossible owing to the absence of the recipient, the ordered Products will be returned to DERMOPHISIOLOGIQUE.

The contract will be terminated and the purchase order cancelled pursuant to Article 1456 of the Italian Civil Code after 30 (thirty) days from the date on which the ordered Products have been sent back to DERMOPHISIOLOGIQUE due to the impossibility to effect delivery. DERMOPHISIOLOGIQUE will reimburse the amount paid by the Purchaser net of the cost of returning the Products and the cost of storing the same at the branch of the carrier responsible for delivery.

The termination of the contract and the amount to be reimbursed will be communicated via email. The refund will be credited to the Purchaser using the same means of payment originally used by the Purchaser when placing the order. If the Purchaser asks DERMOPHISIOLOGIQUE to attempt a second delivery of the Products within thirty days, DERMOPHISIOLOGIQUE shall do so, debiting the Purchaser the extra cost of delivery as well as the cost of returning the Products to DERMOPHISIOLOGIQUE and any storage expenses.

Upon delivery of the Products by the carrier appointed by DERMOPHISIOLOGIQUE, the Purchaser must carefully check:

a) that any tamper-evident seals are intact and that the packaging is not damaged or otherwise altered;

b) that the number of items is the same as that indicated in the transport document.

The Purchaser must report any damage to the tamper-evident seals, the packaging and the products or any inconsistency between the number of items/packs or indications immediately. To do this, the Purchaser should send an email to DERMOPHISIOLOGIQUE Customer Service (servizioclientiweb@dermophisiologique.it) specifying the order affected.

In the event of cases of force majeure, the non-availability of means of transportation, as well as any unpredictable or inevitable events causing delays in delivery or making delivery difficult or impossible or that cause a significant increase in the cost of delivery for DERMOPHISIOLOGIQUE, the same shall have the right to split, postpone or cancel the expected delivery (in whole or in part) or to terminate the Purchase Contract. In such an event DERMOPHISIOLOGIQUE will promptly inform the Purchaser, providing adequate notice of its decision, by sending an email to the email address provided by the Purchaser, who shall be entitled to the refund of any money already paid, excluding any further claims, of whatsoever nature, against DERMOPHISIOLOGIQUE.

The delivery terms indicate the length of time usually required to deliver the Products. The time is calculated from the time the carrier collects the Products from the DERMOPHISIOLOGIQUE warehouse.

Depending on each case, between 3 and 5 working days are needed to deliver the Products within mainland Italy (with reference to the Italian calendar). An extra 1-2 working days are needed for shipments to the islands of Sicily and Sardinia.

DERMOPHISIOLOGIQUE makes every effort to ship the Products within this time, but cannot be held liable for any losses resulting from delays during transportation.

The Purchaser can use any discount vouchers or promotional codes at the time of placing an order. The system will update the total amount due for the order less the value of the voucher/code.

Vouchers can only be combined with other commercial initiatives where expressly indicated.

The Purchaser has the right to withdraw from the contract, without the need to give any reason, within 14 (fourteen) days, as foreseen by Italian Legislative Decree n* 21/2014.

The withdrawal period shall expire (i) 14 days after the day on which the Purchaser or a third party, other than the carrier or person designated by the same, acquires physical possession of the goods, or (ii) in the case of a contract relating to multiple goods ordered in a single order and delivered separately, the day on which the Purchaser or a third party, other than the carrier or person designated by the same, acquires physical possession of the last item in the order to be delivered.

To exercise this right of withdrawal, the Purchaser must inform DERMOPHISIOLOGIQUE (Dermophisiologique S.r.l. - Via IV Novembre, 92 - Bollate (MI) 20021 - ITALY) of his/her decision to terminate the agreement by means of a formal declaration to be sent by registered mail to the address indicated above or by logging onto his/her personal area on www.dermophisiologique.it from the RETURNS section, indicating the order number and details of the objects to be returned/exchanged: http://shop.dermophisiologique.it/en/terms-and-conditions.asp .

In order to meet the deadline for withdrawal, the Purchaser just needs to communicate his/her decision to exercise this right of withdrawal before the end of the withdrawal period.

Should the Purchaser decide to withdraw from this contract, he/she will be refunded without undue delay all payments made to DERMOPHISIOLOGIQUE less any costs of delivery. The money will be refunded using the same means of payment used by the Purchaser for the initial transaction, unless expressly agreed otherwise; in any case, the Purchaser will not incur any extra costs as a result of reimbursement. Any refund may be suspended until receipt of the goods or until the Purchaser can demonstrate he/she has returned the goods, whichever is the earliest.

The Purchaser must return the goods or deliver them in person to DERMOPHISIOLOGIQUE, c/o CEVA Logistics Italy S.r.l. - S.P. 122 Della Francesca, Km 7 ‐ 24040 - Pognano (BG) - Italy, without undue delay and, in any case, within 14 (fourteen) days from the day of announcing his/her withdrawal from this contract. The deadline is met if the Purchaser returns the goods before the expiration of the 14-day period. The direct costs of returning the goods are to be borne by the Purchaser. The Purchaser is liable for any loss in the value of the goods resulting from any handling other than that necessary to establish the nature, characteristics and functioning of the goods.

The Purchaser cannot, in any case, exercise the aforementioned right of withdrawal with regard to sealed goods that cannot be returned for hygienic reasons or health and safety reasons if unsealed after delivery.

The Products offered on the Website comply with Italian and EU laws. The images and colours of the Products published on the Website may differ from the look and colour of the actual Products due to the local settings of the systems and/or devices used to display these.

In the event that a purchased Product does not conform to the description published on the Website or in the event of a faulty or broken Product, the Purchaser is entitled to an immediate refund for the non-conforming goods provided he/she has first sent DERMOPHISIOLOGIQUE Customer Service photographs indicating the damage or non-confomity of the Product.
